This will be the fifth time that the Courts of Barcelona will activate the so-called Fast IP Protocol for the Mobile World Congress 2019, which will be held in Barcelona from 25 to 28 February 2019.
As in previous years, the protocol aims to prevent alleged infringements of industrial property that may occur before and during the event. This includes the possibility for IP rights holders to have access to different options to defend their interests, including measures aimed at the verification of facts (alleged infringements) or the seizure of infringing products. On the other hand, companies may also submit preventive letters in case they suspect they could be sued for infringement of IP rights during the event and thus avoid the execution of precautionary measures against them, without prior hearing.
The main novelty of this year’s protocol edition will be the participation of the European Union Trademark and Design Court, based in Alicante. The courts of Barcelona will also execute, within the scope of their specific competence, the preliminary protective measures granted by the EU Trademark and Design Court in relation to the corresponding EU trademarks and designs.
