A recent judgement by the Court of Justice of the European Union (CJEU) considers legal a clause for which suppliers of luxury products may prohibit their authorized distributors from using third-party platforms on the Internet to sell their products.
The Court considers that this clause, which should aim to preserve the image of these products and that should be established in a uniform and non-discriminatory manner, is more effective than allowing their distributors to sell their luxury products on Internet platforms, provided that they meet the same quality requirements predefined in the selective distribution system.
