As we had previously informed you, a series of amendments to the Spanish Trademark Law came into force last January. Among them it is worth pointing out the notable widening of the catalogue of signs that can be considered trademarks and therefore can be registered.
This widening includes position trademarks which consist in the specific way in which the trademark is placed or appears on the product (the logo of a sneaker); pattern trademarks, consisting of a set of elements that are repeated periodically (the weft of a fabric) or movement trademarks, consisting of a movement or change of position of the elements of the trademark (video files or images).
The new trends brought about by e-commerce are also generating new habits in consumers, not only to access products but also in the way they can be promoted or made visible.
