Protection of European Union trademarks in the United Kingdom after Brexit.

As we have already informed you, the negative prospects for an EU-UK agreement regarding Brexit maintains a high degree of uncertainty about the continuity of EU trademark and design rights. However, the UK government has stated that, irrespective of the outcome of the negotiations, it will recognise the effects of registered EU Trademarks from the effective date of the Brexit, 29.03.19. This recognition would not apply to pending applications or future applications that may be filed after the aforementioned date.

Taking into account that it usually takes about four months to process a EU trademark, we recommend to file now any EU trademark application, in case you were planning to do so in the near future. In this way, by March 2019, you will have obtained a trademark right with effect in the 28 countries that are currently part of the European Union, including the United Kingdom, thus avoiding the need to incur additional costs to obtain protection in that country.
