Urgent processing of the Royal Decree amending the Trademark Law

On 5 April 2019, the Council of Ministers agreed to request the Standing Committee of the Council of Ministers, the urgent issuance of a judgement, before 22 April, regarding the Draft of the Royal Decree amending the Regulations for the implementation of the Law 17/2001 of 7 December, Spanish Trademark Law.

The Spanish Trademark Law was amended at the end of last year to adapt its content to the European Directive on the approximation of the laws of the Member States relating to trademarks, which harmonize the national trademark systems of the European Union to facilitate the registration and management of trademarks.

With this request, the Government wants to avoid the opening of an infringement procedure for failure to meet the deadline set for the transportation of the European directive, which ended on 14 January 2018, and the resulting financial fine.
