Community Design
It is the modality used to protect aesthetic creations (three-dimensional and two-dimensional) in the 27 EU Member States.
By means of a single registration before the European Intellectual Property Office (EUIPO), based in Alicante, the holder of a Community design will obtain protection throughout the territory of the European Union.
As many variants as you like can be protected in the same registration as long as they are within the same classification.
The registration procedure before the Office comprises only a formal examination and it is possible to file an application for a declaration of invalidity against the design after the grant.
Its legal life is 5 years from the design filing date, renewable for periods of 5 years and up to a maximum of 25 years.
The Community design also grants protection to unregistered designs, but only against identical copies and for a period of three years from the first disclosure.
