The new Spanish Trade Secret Act came into force last February. This regulation aims to give legal coverage to intangible assets which have not been subject to registration for various reasons and which, however, would be worthy of legal protection as an integral part of goodwill generated by any business or commercial activity.
We would like to point out that the scope of coverage of this rule goes far beyond that of Intellectual Property, it extends to all sensitive information of a commercial, financial or organisational nature. In order for this protection to be effective, it will be necessary to have previously adopted clear internal guidelines for the identification, classification and access to the information considered vulnerable, as well as to adapt the contractual practices that the affected party has with labour personnel, collaborators, clients and suppliers.
